A Chapter 11 Debtor and her significant other brought an adversary proceeding against the Defendant, who served as bankruptcy counsel for several judgment creditors and filed a proof of claim on behalf of his clients in the Debtor’s bankruptcy case. The Debtor alleged in her complaint that the Defendant aided and abetted a fraudulent scheme to obtain a state court judgment against the Debtor. The Defendant moved to dismiss. Judge Ruark dismissed the case against the Defendant finding that the complaint failed to state a claim upon which relief can be granted.
