A creditor sought to dismiss the Debtor’s Chapter 7 case for alleged lack of good faith arguing the Debtor was solvent, the Debtor had material income, and the bankruptcy filing was premature because the creditor’s claim had not matured into a judgment. The Debtor filed an opposition arguing his bankruptcy filing was not made in bad faith. Judge Ruark denied the motion to dismiss finding the Debtor’s actions did not demonstrate bad faith.
