A Chapter 11 Debtor and her significant other brought an adversary proceeding against a judgment creditor, its owners and its counsel in a state court action. The Plaintiffs alleged that the Defendants fraudulently obtained the state court judgment, which the Plaintiffs appealed. All Defendants filed motions to dismiss the adversary proceeding. Judge Ruark entered an order abstaining from exercising any further jurisdiction over the case to avoid the risk of inconsistent results and in the interest of comity with the state court.
