Plaintiff asked the court to declare that a judgment she held against defendant for more than $2,100,000 was nondischargeable under 11 U.S.C. § 523(a)(2)(A). The Bankruptcy Court, David E. Rice, Judge, held that the judgment was discharged because the plaintiff did not meet her burden by a preponderance of the evidence. The court found that the defendant debtor did not make a false representation or have any intent to deceive the plaintiff, and that in any event the plaintiff did not sustain any damage as a result of the allegedly false representations.
