Courtroom 3D in Greenbelt does not have any installed presentation technology. However, with at least 48 hours advanced notice and the approval of the Judge, a projector and screen can be set up for electronic presentation. Judge Mannes generally agrees to remove motions for relief from stay from the docket if a consent is reached, if there is no response, or if the parties agree to a continuance, if the Courtroom Deputy is contacted by the movant before 12:00 Noon the business day before the hearing. Any request for the matter to be continued to a later date must clearly indicate the movant has obtained the counter party’s consent.
A motion to avoid a lien must be accompanied by evidence of the value of the subject property and evidence of the amount of debt secured by senior liens.
Motion Hearing Dates
Pre-Trial Procedures - In some cases, Judge Mannes will excuse counsel’s appearance at a pre-trial conference if the parties conduct a conference as required by Federal Rule of Civil Procedure 26(f)(1), applicable by FRBP 7026, and the parties then file a joint report pursuant to Rule 26(f)(2) that includes suggested deadlines for completion of discovery, identification of any experts and filing of reports, filing of any dispositive motions, as well as any other schedule the parties request, by 12:00 Noon three (3) days before the scheduled hearing.
Counsel must represent Debtor in reaffirmation agreement negotiations, and the court will not act upon the agreement in the absence of participation by Debtor’s counsel. The attendance of counsel at the hearing on approval of the agreement is not required.
