The Court has entered three new administrative orders that are listed on the registry of Administrative Orders.  Administrative Order 10-01, requiring the addition of the IRS to the mailing matrix of every Chapter 13 case; 10-02, instituting Local Bankruptcy Rule amendments regarding Motions to Avoid Liens and amended pleadings; and 10-03 adopting amended Interim Bankruptcy Rule 1007-1.

EPA Fee Schedule Update - On March 16, 2010, the Judicial Conference of the United States approved an adjustment to the Electronic Public Access Fee Schedule so that users are not billed unless they accrue charges of more than $10 of PACER usage in a quarterly billing cycle, in effect quadrupling the amount of data available without charge. Previously, users were not billed until their accounts total at least $10 in a one-year period. Click here, to view a copy of the latest fee schedule.

Please be advised that the Debtor Assistance Project (DAP) has expanded its hours in Baltimore! The clinic will now run 4 days a week and be open to both pre-scheduled and walk-in appointments. Walk in appointments will be accepted on Tuesdays and Thursdays from 8:00am to 11:30am and Wednesdays from 12:30pm to 3:30pm.

Important Notice Regarding Time Period Changes Effective December 1, 2009, Including 14-Day Deadlines for Filing Schedules, Statements, Chapter 13 Plans, and Bankruptcy Appellate Briefs - Among the time-computation amendments to the Federal Rules of Bankruptcy Procedure that will take effect on December 1, 2009, are changes to 12 rules that will result in a reduction by one day (from 15 to 14 days) of the time to take action. The affected rules are Bankruptcy Rules 1007, 1019, 1020, 2015, 2015.1, 2016, 3015, 4001, 4002, 6004, 6007, and 8009. Please take note of these changes and particularly of the new 14-day deadline for filing schedules, statements, and other documents under Rule 1007(c); for filing a chapter 13 plan under Rule 3015(b); and for filing appellate briefs under Rule 8009(a).

Interim Rule 1007-I included time deadlines contained in Rule 1007, which will be revised effective December 1, 2009, unless Congress acts to the contrary, as part of a comprehensive package of changes to time periods in all the federal rules of practice and procedure. Courts that adopted Interim Rule 1007-I are being urged to consider revising the interim rule, making it consistent with the changed time deadlines in Rule 1007. New Administrative Order 09-02 was signed by Chief Judge Keir for this purpose.

A listing of new bankruptcy cases that have been filed but not yet entered into CM/ECF is now available. The list may be accessed from either the Case Information section or the CM/ECF login page. Parties should continue to use PACER or VCIS (Voice Case Information System) to determine if a bankruptcy case has been filed with the Court. Parties also may telephone the Clerk's office to confirm a bankruptcy case has been filed with the Court.

If you have a saved email address for each CRD, please update it so you are no longer emailing them directly. If the matter is case related, please continue to contact the Case Administrator.

The Maryland Bankruptcy Court launched changes to its website on February 5, 2009, in an effort to make its website more user-friendly to individuals without an attorney (also known as "pro se"). Bankruptcy is a complex area of law, which makes successful navigation of a bankruptcy case difficult for pro se parties. The updated website has a user-friendly design and contains expanded substantive and procedural information on bankruptcy. This information includes a complete listing of resources available to assist individuals in finding an attorney, sometimes at low to no cost. Due to the complexity and long-term financial effects of filing for bankruptcy, individuals are encouraged to obtain legal advice from a competent attorney before filing a petition. Please note that these changes are just the start of the Court’s efforts to assist pro se parties. Any suggestions on how best to do this are welcomed through use of the Suggestion Box.

On October 20, 2008, the National Guard and Reservists Debt Relief Act of 2008 was enacted into law. The Act provides a temporary exclusion from the bankruptcy means test for Reservists and members of the National Guard called to active duty or homeland defense activity after September 11, 2001, for at least 90 days. Please see Administrative Order 08-03 for more details.

On December 1, 2008 Revised Local Bankruptcy Rules become effective. These rules implement the Court Hearing Scheduler (CHS) Program and clarify the computation of time to respond to pleadings pursuant to FRBP 9006 (a) and (f). This version supersedes all prior versions.

Revised Local Bankruptcy Rules become effective. These Rules include a revised Chapter 13 Plan as well as other significant changes. They bear the version number 11.07 at the bottom of each page to distinguish them from the May 2007 Rules.

Judges Nancy V. Alquist and James F. Schneider will permit parties to appear at court hearings telephonically using CourtCall, an independent conference call company. You must contact the courtroom deputy at least 24 hours in advance to confirm that you will be permitted to appear telephonically.  See the procedures for each Judge unde Judge's Info.

Automatic adjustments to the dollar amounts stated in various provisions of the Bankruptcy Code and one provision of Title 28 of the U.S. Code become effective. The amended dollar amounts will apply to cases filed on or after April 1, 2007. Click here for a full description of the changes.

Notice of change of pretrial conference procedures in adversary proceedings/contested matters before Judge Mannes: If parties file R. 26(f) reports at least two (2) weeks before the scheduled pretrial conference hearing date, Judge Mannes will consider allowing the parties to appear by telephone. A similar procedure will be used in contested matters where status conferences are set. You will be advised by chambers, if you may appear by telephone.

Administrative Order 05-04 is amended to include the new language of interim FRBP 1007 and the new exhibit D of the petition regarding the credit counseling certificate. Administrative Order 06-04 is also effective on October 1, 2006, that adopts interim FRBP 1007 (attached at the end of the Administrative Order).

Administrative Order 06-03, Providing to the Trustee a Copy of the Federal Income Tax Return

  • Administrative Order 05-04 Changes to Local Bankruptcy Rules and Procedures is amended. (LBR 1002-(a)(8) is amended to: 1) allow the debtor to check the block on the petition stating that the debtor has received approved budget and credit counseling; and 2) further refines procedures for providing the payment advices to the trustee.
  • Administrative Order 04-01 Directing the Electronic filing of pleadings by attorneys is amended. (Requests for writs in aid of collection or recovery of property must be filed in paper form.)
